These Terms govern your use of the BaridX website, the customer portal and the shipping services BaridX provides. Please read them with the Privacy Policy, the Claims Policy, the Return Shipment Policy and the Refund & Cashout Policy, which form part of them.
1. Who we are
These services are provided by BaridX ("BaridX", "we", "us").
You can reach us at [email protected] or 920019876. Details of how to raise a complaint are set out in the section "Complaints and disputes" below.
In these Terms, "you" or "the customer" means any person who uses the website or the portal or books a service with us, whether an individual or a business; "shipment" means any parcel, document or goods you hand to us to carry; and "recipient" means the person to whom the shipment is addressed.
2. Acceptance and electronic contracting
By creating an account, booking a service or confirming an order through the website or the portal, you accept these Terms. Your electronic acceptance, and the records our systems keep of it, have the same effect as a signed contract under the Electronic Transactions Law.
Before you confirm an order, the booking screen shows you the service, its price including any applicable VAT, and the policies that apply to it. Please review them before you confirm.
If you do not accept these Terms, please do not use our services.
3. Our services
BaridX provides domestic and international shipping, parcel delivery, freight, fulfilment and related services, as described on the website and in the portal at the time you book. We may carry a shipment ourselves or through carriers and service providers we engage; in either case, BaridX remains responsible to you for the shipment in accordance with these Terms and the Claims Policy.
The services, coverage areas and delivery options available to you may change from time to time. A change does not affect a shipment you have already booked.
4. Accounts and eligibility
You must be at least 18 years old and have full legal capacity to open an account or book a service. A business account must be opened by a person authorised to act for the business, and the business is bound by what is done through its account.
You are responsible for the accuracy of the information in your account, for keeping your sign-in details confidential, and for activity carried out through your account. Tell us promptly if you believe your account has been used without your permission.
5. Acceptable use of the website and portal
You may not use the website, the portal or our services:
- for any unlawful purpose, or to help or induce others to break the law;
- to provide false, misleading or incomplete information, including about a shipment's contents or value;
- to infringe our intellectual property or anyone else's rights;
- to harass, abuse, defame or discriminate against anyone;
- to transmit viruses or malicious code, or to collect other people's personal data without a lawful basis;
- to send unsolicited messages; or
- to interfere with, overload or circumvent the security of our systems, or to gain unauthorised access to them or to other users' accounts.
We may suspend access that breaches this section, as set out under "Suspension and termination", and we may report unlawful activity to the competent authorities.
6. Booking, prices and VAT
The price of a service is the price shown when you confirm the booking, calculated from the weight, dimensions, service and destination you declare. Prices include Value Added Tax wherever it applies under the Kingdom's VAT regulations; the tax invoice shows the VAT rate and amount separately, and no VAT is added to a service that is not subject to it.
You are responsible for declaring the weight, dimensions and contents of the shipment accurately. If our measurement shows a different weight or size, or the contents differ from the declaration, we will charge or refund the difference according to the published rates, and we will tell you before we charge it.
Additional services you request (such as insurance, packaging or storage) are charged at the rates shown when you request them.
7. Payment and invoices
Individuals pay when they book. Business accounts pay according to the payment terms of their account or agreement. Card payments are processed by licensed payment service providers; BaridX does not store your full card details.
Amounts that are due and unpaid may lead us to pause new bookings on the account until they are settled. We issue tax invoices electronically in accordance with ZATCA's e-invoicing requirements.
8. Packaging, declaration and acceptance of shipments
- You must hand over each shipment properly packaged and sealed in a condition fit for carriage. Fragile items need additional protective packaging beyond standard packaging, appropriate to their nature.
- Fragile, perishable or sensitive shipments must be declared to us before booking and labelled accordingly. We do not accept unpackaged shipments.
- Each shipment must travel under a valid waybill issued for it. A waybill may be used once only; reusing or re-issuing a waybill is not permitted.
- You are responsible for the accuracy of the sender and recipient details on the booking and the waybill. Costs caused by incorrect details, including re-delivery or return, are charged to the customer.
- We may refuse to accept a shipment, or stop handling it, if it does not meet these requirements or appears to contain prohibited items. If we refuse a shipment before carriage begins, we refund what you paid for it.
9. Prohibited and restricted items
You may not ship items whose carriage, import, export or trade is prohibited under the laws of the Kingdom of Saudi Arabia, the origin or destination country, or the rules of the carriers and customs authorities involved. These include, without limitation: explosives and flammable materials; firearms and ammunition; narcotics; counterfeit goods; cash, precious metals and stones; official documents such as passports and identity cards; human remains; live or dead animals; live plants and seeds; fresh food; hazardous waste; and indecent materials.
Some items are restricted rather than prohibited, such as batteries, medicines, cosmetics and electronic devices, and may need permits, special packaging or a specific service. Please ask us before booking. The customer bears the consequences of shipping a prohibited or undeclared restricted item, including fines, confiscation or return, and such shipments are not covered by the Claims Policy.
10. Inspection of shipments
BaridX may open and inspect a shipment, itself or through the carrier or a competent authority, where reasonably necessary to verify its contents, to confirm that it complies with these Terms and the law, or when a competent authority requests it. Where we open a shipment we reseal it and record that it was inspected.
11. Delivery, delivery times and contacting the recipient
We deliver the shipment to the address and recipient stated in the booking. Delivery times shown at booking are estimates. They exclude weekends, public holidays and time spent in customs, and may be affected by circumstances outside our control. A delay alone does not entitle the customer to compensation, but you may cancel as set out in the Refund & Cashout Policy if the shipment has not yet been collected.
We or the customs authorities may contact the recipient by text message, call or email to arrange delivery or clearance. If we cannot deliver after reasonable attempts, we will contact the sender for instructions. We are not responsible for delay, fines or return caused by the recipient not responding or refusing delivery.
12. International shipping and customs
Shipping fees cover carriage and arranging customs clearance; they do not include customs duties, taxes or charges imposed in the destination country, which are payable by the recipient unless you have chosen a service in which the sender pays them.
Some destinations have additional requirements depending on the country and the goods. For example, some countries (such as Turkey) require the recipient to appoint a private customs broker regardless of value, and some (such as Morocco) require electronic devices to be cleared through a licensed broker. These requirements change; please check with us before booking.
If duties are not paid or the customs requirements are not met, the destination customs authority may confiscate the shipment or return it. BaridX is not responsible for a decision of a customs authority. A shipment returned for these reasons can only be returned once the customs authority allows it, and the return is charged to the sender at the rates then in force, as set out in the Return Shipment Policy.
13. Storage and unclaimed shipments
We may keep a shipment at one of our branches, in the Kingdom or abroad (for example our branch in the United States), when you ask us to consolidate shipments, while we await your instructions, or when a shipment is returned to us. The first 7 days are free. After that, storage is charged at SAR 0.20 per half-kilogram per day until the shipment is sent, collected or otherwise resolved. We will notify you before storage charges begin.
If a shipment remains unclaimed for 90 days after we have notified you at least twice using the contact details in your account, we may, after a final notice, deal with it in accordance with the applicable regulations, and we may set the outstanding storage and shipping charges against any proceeds.
14. Trade restrictions and sanctions
You are responsible for ensuring that your shipment, its origin, destination and the parties to it comply with the trade control, export control and sanctions laws that apply, including those of the Kingdom of Saudi Arabia and the origin and destination countries. We may refuse, hold or stop a shipment where compliance cannot reasonably be confirmed, and we are not liable for the resulting delay.
15. Liability and compensation
BaridX is responsible for a shipment from the time we accept it until it is delivered. Compensation for loss of or damage to a shipment is governed by the Claims Policy, including its limits and how claims are made.
We are not liable for indirect or consequential loss, such as loss of profit, business or opportunity, nor for loss caused by the customer's breach of these Terms, the nature of the goods, inadequate packaging, or the decisions of customs or other competent authorities.
Nothing in these Terms limits or excludes our liability for fraud, gross negligence or wilful misconduct, or any liability that cannot be limited or excluded under the laws of the Kingdom of Saudi Arabia.
The website and the portal are provided as available. We work to keep them secure and running, but we do not guarantee that they will always be uninterrupted or free from errors.
16. Customer responsibility and indemnity
You are responsible for the losses, fines, costs and reasonable legal fees that BaridX incurs because of a breach of these Terms by you, an inaccurate declaration about a shipment, or the shipment of prohibited items, including claims made against us by third parties or authorities as a result.
17. Force majeure
Neither party is liable for delay or failure to perform caused by events beyond its reasonable control that could not have been foreseen or avoided, such as natural disasters, extreme weather, war, civil unrest, epidemics, government action, the closure of ports, airports or borders, or a general failure of carriers or communications ("force majeure").
The time for performance is extended for as long as the event continues, and we will tell you as soon as we reasonably can. Shipment insurance does not cover loss, damage or delay caused by force majeure. If the event prevents delivery for more than 30 days, either party may ask to end the service for that shipment, and we will agree with you whether the shipment is returned or held, and refund any part of the price that relates to services not performed.
18. Cancellation, returns and refunds
Cancelling a booking, refunds, wallet balances and cashout are governed by the Refund & Cashout Policy. Shipments returned to the sender are governed by the Return Shipment Policy. Claims for loss or damage are governed by the Claims Policy.
19. Personal data
We process personal data in accordance with the Personal Data Protection Law and its regulations, as described in our Privacy Policy. When you give us the personal data of a recipient or another person, you confirm that you are entitled to share it with us for the purpose of the shipment.
20. Intellectual property
The BaridX name, logo, website, portal and their content belong to BaridX or its licensors. You may not copy, sell, resell or exploit any part of them, or use our name or marks, without our prior written permission.
21. Suspension and termination
You may close your account at any time by contacting us. Amounts due between us are settled within 60 days of closure, and closing the account does not affect shipments already in progress.
We may suspend or close an account, with notice stating the reason, if these Terms are breached, if amounts due remain unpaid, or if required by law. We may suspend without prior notice only where necessary to prevent fraud, protect our systems or other users, or comply with an instruction from a competent authority, and we will then notify you as soon as possible. The customer remains liable for amounts due up to the date of suspension or closure.
22. Changes to these Terms
We may update these Terms to reflect changes in our services or in the law. We will publish the updated version on this page with its effective date, and we will notify registered customers of material changes by email or in the portal at least 14 days before they take effect, unless a change is required sooner by law.
Changes do not apply to shipments booked before they take effect. If you do not accept a change, you may close your account before it takes effect.
23. Complaints and disputes
If you have a complaint, contact us at [email protected] or 920019876 with your order or tracking number. We acknowledge complaints promptly and aim to resolve them within 5 working days.
If your complaint about a postal or parcel service is not resolved within that time, or you are not satisfied with the outcome, you may raise it with the Transport General Authority through its unified number 19929 or its website. Data protection complaints may also be raised with the Saudi Data and Artificial Intelligence Authority, as explained in the Privacy Policy.
We will try to settle any dispute amicably. If it cannot be settled, it will be referred to the competent courts of the Kingdom of Saudi Arabia.
24. Governing law and language
These Terms and every service provided under them are governed by the laws of the Kingdom of Saudi Arabia. They are published in Arabic and English; if the two versions differ, the Arabic version prevails.
25. General provisions
- If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in effect.
- Not exercising a right is not a waiver of it.
- These Terms, the policies referred to in them and, for business customers, any signed agreement with BaridX, form the whole agreement on their subject. If a signed agreement conflicts with these Terms, the signed agreement prevails.
- BaridX may transfer its rights and obligations under these Terms to an affiliate or a successor entity, provided your rights are not reduced. You may not transfer yours without our written consent.
- We send notices to the email, mobile number or portal account you have registered with us.
